"LOOKING FOR MARY" VIDEO COMPETITION
CONDITIONS OF ENTRY
- Information on how to enter and about the prizes (including the Entry Requirements) form part of these Conditions of Entry (Conditions). By entering the competition, entrants agree to comply with and be bound by these Conditions.
- The promoters of the competition are the Trustees of the Archdiocese of Sydney on behalf of the Catholic Archdiocese of Sydney which operates www.xt3.com (Archdiocese) and Mary MacKillop Canonisation, ACN 141 677 821 (MMC), collectively the Promoters.
- Entry is open to all Australian residents that are aged between 16 and 35 years (inclusive) as at 20 September 2010. Employees and their immediate families of the Promoters and the Promoters' consultants, agents and suppliers and employees and their immediate families of the University of Notre Dame are ineligible to enter. Where an eligible entrant is aged less than 18 years old at the time of submitting their Entry, the entrant must obtain from their parent or guardian consent to enter this competition and confirmation that the entrant and guardian or parent have read and agree with the Conditions.
- Entries for the competition may be submitted from 18 August 2010 until 11:59pm on 20 September 2010. (Entry Period) Voting on www.xt3.com will take place between 16 September 2010 and 26 September 2010 (inclusive).
- To enter, an entrant must complete an entry form and create and submit a 2-3 minute video in accordance with the instructions in the Entry Requirements (Entry). Each entrant may create and submit multiple entries and each entrant must complete an entry form for each entry submitted. Each entrant and their Entry must comply with the Terms and Conditions on www.xt3.com.
- By submitting an Entry, the entrant warrants to the Promoters that:
- the Entry was made by the entrant specifically for this competition;
- the Entry complies with these Conditions;
- the Entry is original;
- no part of the Entry is, or will be, actionable for defamation or invasion of privacy or breach of confidence of any person;
- the rights (including the intellectual property rights) in the Entry have not been, and will not be, assigned, licensed or otherwise granted, in whole or in part, to any person other than to the Archdiocese;
- the entrant is entitled to reproduce and exploit all of the underlying works in the Entry
- the entrant has obtained from each co-creator of the Entry and each performer in the Entry, including to the underlying works in the Entry, (Contributor) the following:
- written consent to do or omit to do anything which may infringe any and all moral rights of the Contributor including to edit, alter and reproduce the work of the Contributor, by the entrant (and any person authorised by the entrant to do so including the Archdiocese, MMC and each of their assignees and licensees) and that such consents have been obtained to the full extent permitted under the Copyright Act 1968 (Cth) (Moral Rights Consents);
- authorisation for the Promoters to use the Contributor's name and likeness in connection with any publicity for the competition; and
- the entrant is entitled to grant to the Archdiocese, MMC and each of their assignees and licensees permission to make use of each and every right and consent referred to in condition 6 (f) and (g) (as applicable) and the use or exploitation of the Entry as contemplated by these Conditions and will not violate the rights (including copyright) of any third party.
- Each entrant authorises the Archdiocese, MMC and each of their assignees and licensees to do any and all acts comprised in the Moral Rights Consents and the entrant consents to the Archdiocese, MMC and each of their assignees and licensees to doing or omitting to do anything which may infringe any and all moral rights of the entrant including to edit, alter and reproduce the work by the entrant in the Entry.
- The Promoters of the competition have the right, in their absolute discretion, to withhold, not publish, remove from the competition website or cancel any Entry that they consider inappropriate or not in keeping with the spirit of the competition. Any Entry that does not comply with these Conditions will be deemed invalid and not eligible to win a prize.
- Each entrant must fully comply with the Entry Requirements, including the condition that each entry must be an original production.
- As a condition of entering this competition, and irrespective of whether an entrant's Entry progresses to the Top Ten or wins a prize in this competition, each entrant agrees to irrevocably and unconditionally assign to the Archdiocese all of his/her right, title and interest (including without limitation all intellectual property rights such as present and future copyright) in and to any material provided by the entrant in participating in this competition (including without limitation the materials submitted as part of the video component of each entrant's Entry). Each entrant warrants that the Entry (which includes the video) is the entrant's original work and does not infringe the intellectual property rights (including without limitation copyright and moral rights) of any third party.
- Multiple entries will be accepted but the video submitted in each Entry must be original and each Entry must comply with these Conditions. Each Entry must be the work of the entrant and, in the case of an entry involving contributions from a Contributor, the Contributor must have provided the entrant with the consent specified in condition 6.
- All Entries submitted will be hosted on www.xt3.com and members of www.xt3.com will be asked to vote for their favourite Entry between 16 September 2010 and 5pm 26 September 2010 (Member Voting Period). The 10 Entries with the most votes at the end of the Member Voting Period (Top Ten) will be submitted for judging by the Expert Panel of Judges (as described in the Entry Requirements) on 26 September 2010.
- This is a competition involving creative thought and practice. Each of the ten Entries with the most votes that comply with the Conditions will be individually judged by the Expert Panel of Judges according to their originality, creativity, and compliance with these Conditions. The judging will take place from 27-30 September 2010.
- Any of the Entries, not just the Top Ten may be used by the Archdiocese, or by MMC, in relation to the activities surrounding the canonisation of Mary MacKillop including, but not limited to, use by the Mary MacKillop Youth Committee. In accordance with condition 10, the Archdiocese will retain copyright on all material entered in the competition. Permission must be obtained from the Archdiocese for use of any of the material entered into the competition. All Entries submitted become the property of the Archdiocese and will not be returned to entrants.
- The Archdiocese and the MMC accept no responsibility for late, lost, incomplete, incorrectly submitted, delayed or misdirected entries.
- The entrants who submitted the Entries judged by the Expert Panel of Judges to be the three best out of the Top Ten may be requested to travel to Sydney at their own expense to accept their prize. Where an entrant cannot attend in Sydney to accept their prize, this will not affect that entrant's chances of winning a prize and the prize will be awarded to them in their absence.
- From the Top Ten:
- the Entry judged to be the best will receive a cash prize of AUD$5,000;
- the Entry judged to be the second best will receive a cash prize of AUD$2,000; and
- the Entry judged to be the third best will receive a Hewlett Packard Model 6730B Laptop plus Office Software
The prizes have been kindly funded by the University of Notre Dame
- The entrant that submitted the Entry will be awarded the prize if that Entry is awarded a prize. All prize values are the recommended retail value (including GST) in Australia as provided by the supplier and are correct at the time of publishing. The Promoters are not responsible for any variation in the value of the prize. The Promoters and its associated agencies and companies accept no responsibility for prizes damaged or lost in transit. If a prize is not claimed, the Promoters, may in their absolute discretion instruct the Expert Panel of Judges to select an alternate winner to receive the prize.
- It is a condition of accepting any prize that the winner of a prize must sign a release and exclusion of liability form (provided by the Archdiocese and the MMC) in favour of each of the Archdiocese and MMC. If a winner or winners in relation to a particular winning entry do not sign the release form, the winner's entry or claim to a prize will be deemed invalid.
- The Promoters' decision is final in any matter relating to or arising out of the conduct of this competition and no correspondence will be entered into.
- Each prize is not transferable or exchangeable and, where a prize is not cash, it cannot be taken as cash, unless otherwise specified.
- The Promoters will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of or in connection with this competition if the deficiency is occasioned by any cause outside the reasonable control of the Archdiocese and MMC, including without limitation technical malfunctions or failures.
- The Promoters are not responsible for any costs incurred by an entrant in any way associated with this competition including, but not limited to an entrant's participation in this competition. While www.xt3.com is a free website, any costs associated with accessing the www.xt3.com website are the entrant's responsibility and are dependent on the internet service provider used.
- The Promoters are not responsible for any technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the internet or at any web site, or any combination thereof, or any other technical failures, including any injury or damage to participants' or any other person's computer related to or resulting from participation in or downloading any materials in this competition.
- If for any reason this competition is not capable of running as planned in any respect due to any cause beyond the reasonable control of the Promoters, the Promoters reserve the right in their sole discretion to cancel, postpone or amend the competition.
- The Promoters reserve their right in their sole discretion to disqualify any individual who it has reason to believe has breached any of these Conditions, criteria or any instructions or directions on www.xt3.com, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. The respective legal rights of each of the Archdiocese and MMC to recover damages or other compensation from such an offender are reserved.
- The Promoters and any associated agencies and companies will not be liable for any loss (including, without limitation, loss of profits or other indirect or consequential loss), personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
- Each entrant releases the Archdiocese and MMC from any liability arising from that entrant's participation in this competition.
- The three winners, and any other entrants which the Promoters request, must enter into a contract with the Archdiocese and the MMC whereby the entrant (amongst other things):
- confirms the warranties already agreed to in these Conditions;
- formalises the assignment to the Archdiocese of all copyright and any other intellectual property rights in the Entry;
- indemnifies the Archdiocese and the MMC; and
- releases the Archdiocese and the MMC from any liability arising from the use by the Archdiocese or the MMC of the video and participation in the competition.
This contract may include any other provision the Archdiocese and the MMC deems relevant. Refusal by an entrant to sign such an agreement or any other document requested by the Archdiocese and the MMC will result in that Entry being deemed invalid.
- The entrant agrees to indemnify the Archdiocese and the MMC against all claims by third parties and costs incurred by the Archdiocese and the MMC arising from breach of any warranty set out in these Conditions.
- Each entrant acknowledges and agrees that the Archdiocese and the MMC have the right, in their absolute discretion, to edit, amend, copy, use, publish, synchronise, broadcast and communicate to the public, the video submitted in an Entry or an excerpt from the video submitted, in any media including the internet, without any further consultation, reference, payment or any other compensation to the entrant. This includes, without limitation, the Archdiocese's and the MMC right to re-record, produce and market the entrant's video
- Each entrant acknowledges that they will not receive a royalty, commission, or any other financial benefit from participation and entry into this competition or from the reproduction, communication or other exploitation of the entrant's Entry.
- Each entrant agrees to participate and co-operate in any publicity activities connected with the competition. This may include having photographs taken of them (and their prize) and having their name and picture appear in advertising, marketing and publicity material worldwide at the discretion of the Archdiocese and the MMC. Each entrant acknowledges that they will not receive any compensation in this regard, and the Archdiocese and the MMC will determine, in its absolute discretion, the content, format and style of any material to appear in such publications. Each entrant authorises the Promoters to use the entrant's name and likeness in connection with any publicity for the competition and related activities.
- The Archdiocese and the MMC may require any entrants to provide proof of identity proof of age and proof of Australian residency. Identification considered suitable for verification is at the discretion of the Archdiocese and the MMC.
- The information entrants provide will be collected and used by the Archdiocese for the purpose of conducting this competition. The Archdiocese is bound by the National Privacy Principles and the Privacy Act 1998. Personal information from all Entries will be collected and used to conduct this promotion (this may include disclosing the information to MMC and other third parties to process and conduct the promotion) and for publicity purposes surrounding this promotion. By entering this promotion the entrant consents to the use of their information as described. You may access and/or change their data by following the procedures in the Archdiocese's privacy policy which is available at http://sydney.catholic.org.au/others/privacy.shtml.
- The Archdiocese and the MMC reserve the right to verify the validity of Entries and reserve the right to disqualify any entrant who the Archdiocese and MMC believe either has tampered with the entry process or has submitted an Entry which is not in accordance with these Conditions or acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
- Failure by an entrant to fully comply and adhere to these Conditions may result in that Entry being deemed invalid.
